Domestic Violence Act

Ana Maria has experience representing both plaintiffs and defendants in Domestic Violence cases wherein an individual was seeking a Final Restraining Order (“FRO”) against another. The NJ Prevention of Domestic Violence Act (NJS 2C:25-17 et seq.) is specific as to whom it protects and what act/s qualify as an act of domestic violence. A final restraining order is quasi criminal in nature in that any alleged violations of same will result in criminal charges and may lead to a criminal conviction. The consequences of a FRO can be long-lasting and impact your job, your residence, and custody. As such, it is important to have legal representation if you find yourself defending or seeking an FRO. Victim’s Assistance and Survivors Protection Act New Jersey Victim’s Assistance and Survivor Protection Act (VASPA) Protective Orders (PO) are available to those do not qualify for an FRO under the NJ Prevention of Domestic Violence Act. Protective Order (12th line down) requires that a victim prove by a preponderance of the evidence that he or she was subjected to cyber harassment, stalking and/or non-consensual sexual contact, sexual penetration, lewdness, or an attempt to do so. Neither pending criminal charges nor a conviction are required to satisfy the first prong of VASPA. Undoubtedly, regardless of whether you are a plaintiff or a defendant seeking a PO under VASPA, you should have legal representation.
